Mohanlal Secures Relief From Delhi High Court in Personality Rights Case; Court Orders Takedown of Infringing Content

By Sakshi Navare

Superstar Mohanlal has finally secured relief from the Delhi High Court, as the court has said it will pass an order directing the takedown of material infringing upon the actor’s personality rights and copyright. The decision comes after the “Drishyam” star recently approached the High Court seeking protection of his personality rights.

Justice Jyoti Singh, who was hearing the suit filed by Mohanlal for the protection of his personality rights, said that the parties to the matter would have to submit a note by 4:30 pm today, following which the order would be passed, as per Bar and Bench. The court has also directed intermediaries, including several social media platforms, to provide Basic Subscriber Information (BSI) of those who uploaded the infringing content within two weeks. Mohanlal has also been granted permission to add more defendants to the suit.

During the hearing, Justice Singh also questioned one e-commerce platform over the sale of material using Mohanlal’s image and name without his consent, thereby violating his personality rights. “Blatantly using someone’s image, why? Tell me if you have taken it down, I will record it,” the judge said.

The court was later informed that the unauthorised merchandise had already been taken down. As for the other infringing URLs, the concerned parties have been asked to submit a note on the links being pressed and those being given up. The next date of hearing in the matter is July 4. Advocates M.F. Philip, Sreehari Indukaladharan, Smitha Damodaran Nair, and Togin Babichen appeared for Mohanlal.

Over the years, several actors and public figures have moved courts to secure personality rights, including Amitabh Bachchan, Anil Kapoor, and several notable names from the world of cricket and other public spheres. Most recently, the court also passed an order protecting Sonakshi Sinha’s personality rights.
